01 This agreement

These Terms are an agreement between you and Moon Eye Collective covering the Shamanda app and this website. By downloading, opening, or using Shamanda, you agree to them. If you don't agree, please don't use the app. Our Privacy Policy is part of these Terms.

02 Who may use Shamanda

You need to be at least 13 years old, or 16 if you are in the UK, EU, or EEA. If you are under the age of majority where you live, a parent or guardian must agree to these Terms with you. You also confirm you are not barred from using the app under applicable law.

03 What Shamanda is not

Shamanda is not healthcare. The Journeys, Rituals, Visions, and drum timer are offered for reflection, practice, and personal exploration. They are not medical, psychological, or psychiatric advice, diagnosis, or treatment, and they are not a substitute for care from a qualified professional. Nothing in the app is a clinical claim.

Please take care of yourself. Journey work can bring up strong emotion, memory, or bodily sensation. Go at your own pace. Stop when you need to. If something opens that feels like more than you can hold alone, please reach for support: a therapist, a doctor, an elder, a friend.

Do not use Journeys or the drum timer while driving, or while operating machinery, or anywhere that a change in attention could put you or anyone else at risk. These practices are designed to shift where your attention goes.

Speak to a doctor first if you have a seizure disorder or are sensitive to rhythmic or repetitive sound, or if you are in treatment for a dissociative, psychotic, or trauma-related condition.

If you are in crisis, please contact your local emergency number or a crisis line. In the United States, call or text 988. Shamanda is not an emergency service and no one is monitoring it for emergencies.

04 Your account

You are responsible for what happens under your account and for keeping your sign-in details to yourself. Give us accurate information and keep it current. Tell us if you think someone else has got in. You may use much of Shamanda without an account; some features need one.

05 PRO subscriptions

Shamanda offers a free tier and a paid PRO subscription that unlocks the full Journey library and additional practices. Current prices, lengths, and what is included are shown in the app before you buy.

  • Billing. Subscriptions are sold and billed by Apple through the App Store, or by Google through Google Play, not by us. Payment is charged to your Apple or Google account at confirmation of purchase.
  • Auto-renewal. Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the period ending.
  • Cancelling. Manage or cancel a subscription in your Apple or Google account settings. Deleting the app does not cancel a subscription. If a free trial is offered, any unused portion is forfeited when you buy a subscription.
  • Refunds. Refunds are handled by Apple or Google under their policies. We cannot issue them ourselves, though if something has gone wrong, write to us and we will help you where we can.
  • Price changes. We may change prices. Changes apply from the next renewal, and you'll be told in advance and given the chance to cancel.

06 Your content

What you write is yours. Your private journal entries stay on your own device and never reach us at all.

When you post something into the community feed, you give us a non-exclusive, worldwide, royalty-free licence to store, display, and share it inside Shamanda so the feature can work. That licence exists only to run the app. It ends when you delete the post, except for copies already made in ordinary backups. We will not sell your writing, put advertising against it, or train models on it.

07 In the community

The community is a shared fire. Tend it: speak from your own experience, make room for doubt, and assume good faith. Please do not post anything harassing, hateful, threatening, sexually explicit, or unlawful; anything that impersonates someone else; anything that is not yours to share; medical or clinical advice; or spam and promotion. We may remove posts and suspend accounts that make the space unsafe.

08 On lineage and respect

Shamanda draws on shamanic traditions carried by living peoples. We name what we are inspired by and credit sources where we can, and we ask the same care of you. Please do not use the community to claim, sell, or misrepresent teachings or ceremonies that are not yours to hold. If you believe we have gotten something wrong, tell us. We would rather hear it than not.

09 What belongs to us

Shamanda (the app, its audio recordings, Journey and Ritual scripts, Visions, text, design, and the Moon Eye Collective and Shamanda names) belongs to us or to the people we license it from, and is protected by copyright and trademark law. Your subscription buys you a personal, revocable, non-transferable licence to use it for your own practice. You may not copy, redistribute, rip, re-upload, resell, publicly perform, or make derivative works from our content without written permission.

10 Acceptable use

Please don't:

  • Reverse engineer, decompile, or try to extract our source or audio files
  • Circumvent PRO gating or access content you haven't paid for
  • Scrape the app, hammer our servers, or run automated access against them
  • Interfere with security, or probe it without our written permission
  • Use Shamanda to break the law, or to harm someone

11 Ending things

You can stop at any time: cancel any subscription through Apple or Google, ask us to delete your account, and delete the app. We may suspend or end your access if you materially breach these Terms, or if we have to for legal or safety reasons, and we'll tell you why unless we're prevented from doing so. Sections 6, 9, 12, 13, 14, and 17 survive the end of this agreement.

We may also change, pause, or discontinue features. If we ever shut Shamanda down, we will give reasonable notice and a way to take your information with you.

12 Disclaimers

Shamanda is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, or that any particular outcome, insight, healing, or experience will follow from using it.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits rights you have as a consumer that cannot be limited by law.

13 Limitation of liability

To the fullest extent permitted by law, Moon Eye Collective and its founders, members, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of Shamanda. Our total liability for any claim relating to Shamanda is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

14 Indemnification

You agree to indemnify and hold Moon Eye Collective harmless from claims, damages, and reasonable legal costs arising from content you post, your misuse of the app, or your breach of these Terms.

15 Apple and Google

If you obtained Shamanda from the Apple App Store, you acknowledge that:

  • These Terms are between you and Moon Eye Collective only, not with Apple
  • Apple has no obligation to furnish maintenance or support for the app
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation
  • Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory, or intellectual property claims
  • You will use the app only in compliance with the App Store Terms of Service, and you are not located in a country subject to a US embargo or on a US restricted-parties list
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

Similar terms apply where you obtained Shamanda from Google Play, under the Google Play Terms of Service.

16 Changes

We may update these Terms. We'll change the date at the top, and for material changes we'll tell you in the app before they take effect. Continuing to use Shamanda after that means you accept the new Terms.

17 Governing law

These Terms are governed by the laws of the United States and of the state in which Moon Eye Collective is organized, without regard to conflict-of-laws rules. You and we agree to bring any dispute in the courts of that state, and each of us consents to their jurisdiction. If you are a consumer in the UK, EU, or EEA, this does not deprive you of the protections of your local law or of your right to bring proceedings where you live.

Before filing anything, please write to us. Most things can be settled by two people talking.
